New gas check changes offer flexibility on timing

Lettings agents and landlords may have more flexibility over timings in future with regard to their legal responsibilities to ensure gas checks are carried out in private rental properties.

The Changes to the Gas Safety (Installation and Use) Regulations 1998 (GSIUR) do not reduce any commitment to carrying out the safety checks or upholding the safety standards but do allow some flexibility over when the checks are carried out.

From 5th April 2018, agents and landlords will be permitted to carry out the annual gas safety check in the two months before the checks are due whilst retaining the existing expiry date.

According to The Health & Safety Executive this will avoid the need for agents and landlords to wait until the due date and then find difficulty gaining access, or having to reduce the yearly cycle to comply with the regulations.

The legal requirement for an annual gas safety check or for maintenance to be carried out does remain in force and is an important part of ensuring tenants’ safety. If you require any advice about lettings regulations please contact your local Frost Partnership lettings team
